Last updated: September 1, 2026
1. Agreement to these terms
McNish Parts (the “Application”) is a private web application at mcnishparts.com, provided by McNish, LLC (“McNish,” “we,” “us”) to a limited group of authorized users. By signing in to or using McNish Parts, you agree to these Terms of Use. If you do not agree, do not sign in.
The landing page at mcnishparts.com is publicly reachable, but everything beyond it requires an account issued by McNish. Simply viewing the landing page does not create any relationship with McNish and does not grant any right of access.
McNish Parts is not a public service and is not offered for sale. Access is a revocable permission granted by McNish, not a right you purchase or own.
1.1 Relationship to other agreements
Many McNish Parts users are personnel of independent sales representative firms that have signed a written representative agreement with McNish. Those agreements govern the commercial relationship, including confidentiality and the handling of McNish information. These Terms are additional to, and not a replacement for, any such agreement.
If these Terms conflict with an executed agreement between McNish and your employer or firm, that agreement controls. Nothing here is intended to reduce, expand, or reinterpret the obligations in it.
2. Who may use McNish Parts
You may use McNish Parts only if all of the following are true:
- You are at least 18 years old
- McNish has issued you an account, or authorized an administrator to issue you one
- You are either a McNish employee or personnel of a firm operating under a current representative or distribution agreement with McNish
- Your access has not been suspended or terminated
Your account is personal to you. You may not share your credentials, allow another person to sign in as you, or use an account issued to someone else. You are responsible for everything done through your account.
If you learn or suspect that your account has been accessed by someone else, notify McNish immediately at security@mcnishparts.com.
3. What McNish Parts shows you and why
McNish Parts presents, within your assigned sales territory:
- McNish installation records, read from McNish’s system of record, describing equipment, facilities, and service history
- Publicly available facility and compliance information, sourced from the United States Environmental Protection Agency’s Enforcement and Compliance History Online (ECHO) system
- Prioritization indicators derived from that public information
McNish Parts exists for one purpose: to help you identify and prioritize sales and service opportunities for McNish products within your territory. Use it for that purpose and no other.
4. Permitted use
Subject to these Terms, McNish grants you a limited, personal, non-exclusive, non-transferable, revocable permission to access and use McNish Parts, during the period your access is authorized, solely to sell and support McNish products and services within your assigned territory.
5. Restrictions
You may not:
- Access, or attempt to access, records outside your assigned territory, or take any step to circumvent, probe, or defeat the application’s access controls
- Extract, scrape, bulk download, or systematically copy data from McNish Parts, whether manually or by automated means, other than the export functions the application itself provides
- Load McNish Parts data into any other system, including a personal CRM, spreadsheet library, or artificial intelligence service, except as McNish authorizes in writing
- Use McNish Parts data for the benefit of any person or business other than McNish and your authorized representation of McNish, including to sell, promote, or service competing products
- Retain or continue to use McNish Parts data after your access ends
- Share McNish Parts data with anyone who is not an authorized user, including within your own firm
- Reverse engineer, decompile, or attempt to derive the source code, data model, or scoring methodology of the application
- Interfere with the operation or security of McNish Parts, or use it to transmit malicious code
- Use McNish Parts in violation of any applicable law, or in any manner that could expose McNish to legal liability or reputational harm
- Represent yourself as speaking for McNish beyond the authority granted in your employment or representative agreement
6. Confidentiality of McNish Parts information
The McNish installation data in McNish Parts, and the compiled and scored views the application produces, are confidential and proprietary to McNish, regardless of whether individual underlying facts are publicly available elsewhere. You must treat them as confidential information under your employment or representative agreement, and use them only for the permitted purpose in section 4. Where your agreement with McNish defines confidentiality obligations, those definitions and obligations apply here.
7. Ownership
McNish owns McNish Parts, its content, and its data, including the installation records, the compiled facility database, the scoring methodology, and all software, design, and trademarks. Public EPA records remain public records; McNish claims no ownership of the underlying government data, only of its compilation, enrichment, and presentation within McNish Parts.
Nothing in these Terms transfers any ownership interest to you.
8. Important limitations on compliance information
Read this section carefully. It governs how you may interpret and use the environmental information in McNish Parts.
The source is public government data. Facility, permit, violation, and enforcement information in McNish Parts is drawn from EPA ECHO. McNish does not create, verify, audit, or correct that data. It may be incomplete, delayed, superseded, or inaccurate at the source, and it is refreshed only on a scheduled basis, so what you see may not reflect a facility’s current status.
Scores are prioritization aids, not findings. Any tier, score, or indicator McNish Parts displays is an internally developed heuristic for ranking sales outreach. It is not a regulatory determination, a compliance opinion, an environmental assessment, a legal conclusion, or a prediction of enforcement. It has no official standing of any kind.
No reliance. Do not rely on McNish Parts to determine whether a facility is in compliance with any law, permit, or regulation. Anyone needing that determination should consult the official EPA record or qualified professional advisors.
No external representations. You may not tell a customer, prospect, regulator, or any other third party that McNish has evaluated, assessed, rated, or certified their regulatory or environmental compliance status, or use a McNish Parts score as a claim about them. Referring a customer to publicly available EPA information is fine. Presenting a McNish score as a compliance judgment is not.
Use good judgment in the field. Compliance history is sensitive commercial territory. Use this information to decide where to spend your time, not as a sales argument built on a customer’s regulatory difficulties.
9. Availability and changes
McNish Parts is provided on an as-available basis. We may modify, suspend, or discontinue any part of it, including data sources, features, and territory definitions, at any time and without notice. There is no service level commitment, guaranteed uptime, or guaranteed data refresh interval associated with your access. Scheduled maintenance and data refreshes may make the application temporarily unavailable or its data temporarily stale.
10. Disclaimer of warranties
To the maximum extent permitted by law, McNish Parts and all data in it are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. McNish expressly disclaims all implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
Without limiting the foregoing, McNish does not warrant that McNish Parts will be uninterrupted, secure, or error free, that its data is accurate, complete, or current, or that any result, opportunity, or sale will follow from its use.
11. Limitation of liability
To the maximum extent permitted by law, McNish and its affiliates, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunity, lost commissions, or loss of data, arising out of or relating to McNish Parts, whether based in contract, tort, strict liability, or any other theory, and whether or not McNish was advised of the possibility of such damages.
McNish’s total aggregate liability arising out of or relating to McNish Parts and these Terms will not exceed one hundred United States dollars ($100).
These limitations apply to your use of McNish Parts as a tool. They do not limit, and are separate from, any obligation McNish owes your firm under a representative or distribution agreement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.
12. Indemnification
You will indemnify and hold harmless McNish and its affiliates from any claim, loss, liability, or expense, including reasonable attorneys’ fees, arising from your use of McNish Parts in violation of these Terms, your violation of applicable law, or your misuse or unauthorized disclosure of McNish Parts data. This section does not apply to conduct within the scope of your employment by McNish.
13. Suspension and termination
McNish may suspend or terminate your access at any time, with or without notice or cause, including if we believe you have violated these Terms or that your account has been compromised.
Your access ends automatically, without any action by McNish, when your employment with McNish ends or when the representative or distribution agreement under which you were granted access ends or is suspended.
On termination, you must stop using McNish Parts and must destroy or return any McNish Parts data in your possession, in whatever form, in accordance with your employment or representative agreement. Sections 5 through 12, this section, and section 14 survive termination.
14. General
Governing law and venue. These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. The state and federal courts located in Cook County, Illinois have exclusive jurisdiction over any dispute, and you consent to venue there.
Third-party sign-in. McNish Parts uses Google and Microsoft single sign-on and a third-party authentication provider. Your use of those services is also subject to their own terms and privacy policies. McNish is not responsible for them.
Privacy. Our handling of personal information is described in the Privacy Policy, which is incorporated into these Terms.
Changes to these Terms. We may update these Terms. We will update the “last updated” date and, for material changes, provide notice through the application or by email. Continued use after the effective date means you accept the updated Terms.
Entire agreement, severability, waiver. Subject to section 1.1, these Terms are the entire agreement between you and McNish regarding your use of McNish Parts. If any provision is held unenforceable, the rest remains in effect. A failure to enforce any provision is not a waiver of it.
Assignment. You may not assign or transfer these Terms or your account. McNish may assign them freely.
